Permit required (Section 4.1)
No Person shall conduct Open Air Burning during Fire Season unless a valid Permit has been issued, except as provided in Section 4.3.
Wind and weather conditions (Section 4.8)
No Open Air Burning shall occur when wind or weather conditions cause: a) risk of fire spread; b) reduced visibility on roadways; c) odour or smoke causing discomfort; d) excessive smoke or other Adverse Effect; or e) a Dangerous Condition.
Dangerous Condition definition (Section 3.1(k))
"Dangerous Condition" means any condition that increases the risk of fire spread, including: (i) lack of precipitation; (ii) high winds (15 km/h or greater); (iii) a provincial or municipal burn prohibition, (iv) any condition identified by the Fire Chief or Designate as hazardous.
Fire season and burning hours (Section 6.1)
During the Fire Season, a Person shall only be permitted to conduct Open Air Burning 2 hours before sunset until 2 hours after sunrise, seven (7) days a week.
Permit types (Section 3.1, definition of Permit)
"Permit" means a permit issued by the Municipality or its authorized agents ... and may include the following types: (i) Seasonal Permit ...; (ii) Incinerator Permit ...; (iii) Specialty I Permit ...; and (iv) Specialty II Permit ...
Short-Term Rental permit requirement (Section 5.8)
A Permit is required for Open Air Fires, on a property operated as a Short-Term Rental. The Short-Term Rental Operator is solely responsible for obtaining the Permit, monitoring compliance, and ensuring that all guests adhere to all Open Air Fire rules and fire safety requirements.
Schedule A - wind limit (permit terms)
The permit holder must ensure that the smoke from the burning operation does not interfere with the movement of vehicular traffic or any other person and will not burn when winds are greater than 15 kilometers per hour.
