General prohibition / permit required (Section 2.1)
No person shall set or permit open-air burning, except in compliance with this By-Law. No person shall set or permit open-air burning, except under the authority of a permit.
Permit required annually (Section 2.2)
Permits are required annually for open-air burning (from April 1 to October 31). A permit holder must abide by all the conditions of this By-Law. The permit holder shall upon request of an enforcement officer, produce the permit for inspection. Permits may be subject to fees.
Hours of burning (Section 2.3)
No person shall set or maintain an open-air fire, except for cooking, warmth and recreation, sooner than 2 hours before sunset and shall extinguish it no later than 2 hours after sunrise.
Fire bans (Section 2.4)
Notwithstanding any other provisions of this By-Law, the Chief Fire Official may impose a municipal fire ban prohibiting all open-air fires for the whole or any part of the Township, when weather or other conditions so warrant, for any period of time as the Chief Fire Official deems necessary.
Waste (Section 2.5)
No person shall burn waste in an open-air fire. No person shall have an open-air fire in a burn barrel.
Recreational open-air fire requirements (Section 2.7)
Use an Open-air Burning Device; While the fire is burning, have immediately available at or near the location of the fire at all times of the open fire a suitable means of extinguishment ... Ensure that there is constant supervision and control over the fire by a competent adult from start to extinguishment.
Non-recreational open-air fire size/setback (Section 5.1)
The burn pile is less than 1 metres (3.37 feet) in diameter and less than 1 metres (3.37 feet) in height ... At least 20 metres (66 feet) from any adjacent building or structure; At least 20 metres (66 feet) from any adjacent property line.
Wind velocity (Section 5.2)
No person shall set, maintain, or cause or permit to be set or maintained a nonrecreational open-air fire when there is a wind exceeding 15 kilometres per hour. (example a flag flying full out)
Penalty (Section 7.2(2))
Notwithstanding the provisions of this Part, any person convicted of contravening any provision of this By-Law is liable to a fine of not more than $5,000.00 exclusive of costs recoverable as set out in The Provincial Offences Act, R.S.O. 1990, Chapter P.33.
Coming into force / repeal (Section 9.1-9.2)
This By-Law No.1897-22 shall come into force on the day it is passed. Upon the coming into force of this By-Law, By-Law No. 1435-12 and 1893-22 are hereby repealed.
