Maximum 1 year, at the discretion of the Chief Fire Official
General outdoor-fire-container or cooking fires do not require an individual application if the Section 3 conditions (hours, size, setbacks, wind/weather, supervision) are met. Fires on farm-regulated land otherwise prohibited require applying to the Chief Fire Official for a Fire Permit at least 3 working days ahead using the Schedule 'A' application form
A fire permit will not be issued until a property inspection (including smoke alarms) is conducted.
General prohibition / approval required (Section 2.1)
No person shall set, maintain, or permit to be set or maintained, an Open Air Burning except as authorized under this By-law or unless approved by the Fire Chief or his designate.
Outdoor Fire Container conditions (Section 3.1(2))
(a) shall only conduct the Open Air Burning between 4:00 p.m. and Midnight; ... (e) shall not burn or attempt to burn a volume of combustible material greater than 61 centimetres (24 inches) wide by 61 centimetres (24 inches) long by 61 centimetres (24 inches) high; ... (g) shall locate Outdoor Fire Container at least 4.5 metres (14.75 feet) from any building, structure, property line, tree, hedge, fence, roadway, overhead wires or other combustible articles.
Cooking fire hours (Section 3.2(2)(a))
shall only conduct the Open Air Burning between 06:00 a.m. and Midnight.
Wind/weather/smog conditions (Section 3.3)
(h) shall ensure the Wind Speed does not exceed 15 km per hour (9 miles per hour) during the Open Air Burning; (i) shall not burn if it is rainy or foggy; (j) shall not burn if a Smog Alert has been declared.
Agricultural Fire Permit (added by By-law 21-5141, Section 3.4)
Upon the application of any person to the Chief Fire Official or designate for the setting of a fire otherwise herein prohibited, the Chief Fire Official or designate may give his/her consent in writing in the form of a Fire Permit upon the following terms and conditions: (a) That no provincial enactment, law or regulation shall be infringed by the setting of such fire. (b) That the fee for such a permit, if any, be paid by the applicant, and the amount of such fee shall be set by Council.
Agricultural permit term (By-law 21-5141, Section 3.9)
All burn permits will be issued to a maximum of a one (1) year time period at the discretion of the Chief Fire Official.
Built Up Residential Area - defined (By-law 21-5141, Part 1)
"Built Up Residential Area" means any area within the Town of Ingersoll, that in the opinion of the Chief Fire Official or designate, open-air burning would cause a fire hazard or an air quality concern for neighbouring structures or properties.
