Permit required (Section 4.1-4.2)

No person shall set or maintain an open air fire without first having obtained the necessary permit from the Fire Chief. No person being the owner or tenant in possession of lands within the municipality shall cause or permit a fire to be set on such lands unless a permit has been issued by the Fire Chief in respect to that fire.

Wind threshold (Section 4.6(k))

No fire in the open air shall be started or maintained when the wind speed is in excess of twenty (20) kilometers per hour.

Smog Alerts (Section 14.1)

All open air burning shall be restricted on days when smog alerts are issued by Environment Canada.

Burn ban (Section 16)

Notwithstanding the provisions of this by-law, the Fire Chief or his designate may institute a burn ban at any time, as may be deemed necessary to protect the natural environment, and no person shall be entitled to a burn permit during a burn ban.

Agricultural lands conditions (Section 5.3)

As part of a farm business in conformance with 5.2 open air burning shall be: Not greater than 3 meter in length, width and height; Permit or allow the open air burn to be located not less than 30 meters away from any building, structure, property line, tree, hedge, fence, roadway, overhead wire or combustible material; Ignite and extinguish the fire between sunrise and sun set of the same day.

Fees (Schedule B)

Outdoor Wood Burning Appliance Permit: Annual $30.00. Open Air Burning Permit: Daily $15.00; Weekly $25.00. Agricultural Burning Permit: Annual $125.00. Campgrounds/Camp Sites: Annual $50.00. Special Burn Permits: $500.00 to $100.00 per occurrence.

Penalty (Section 20.4)

Any person who violates any provision of this by-law is, upon conviction, guilty of an offense under the Fire Protection and Prevention Act, 1997, and if convicted to a fire of not more than $50,000 or imprisonment for a term of not more than one year, or both.
